Agreement Overview
By downloading, installing, or using Shark, you agree to these terms. If you don't agree, please don't use the app.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Shark mobile application ("App", "Service") provided by Shark ("we", "us", "our"). By accessing or using our App, you agree to be bound by these Terms.
2. Description of Service
Shark is a period tracking and women's health application that provides:
- Menstrual cycle tracking and logging
- AI-powered cycle predictions
- Symptom and mood tracking
- Health insights and analytics
- Optional iCloud synchronization
- Apple HealthKit integration
Medical Disclaimer
Shark is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The predictions and insights provided are for informational purposes only. Always consult with a qualified healthcare provider for medical advice, diagnosis, or treatment. Do not rely on Shark for contraception or fertility planning without consulting a medical professional.
3. Eligibility
You must be at least 13 years old to use Shark. By using the App, you represent that you meet this age requirement. If you are under 18, you should have parental or guardian permission to use this App.
4. User Accounts
Shark does not require account registration. Your data is stored locally on your device and optionally synced via your personal iCloud account. You are responsible for:
- Maintaining the security of your device
- All activity that occurs through your use of the App
- Your iCloud account security if sync is enabled
5. Subscriptions and Payments
Free Features
Shark offers free features including basic period tracking, calendar view, and limited history.
Premium Subscription
Premium features require a paid subscription. Subscriptions are processed through Apple's App Store:
- Payment is charged to your Apple ID account
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
- Prices may vary by region and are subject to change
Lifetime Purchase
A one-time lifetime purchase option may be available, granting permanent access to premium features.
Refunds
Refunds are handled by Apple according to their App Store policies. Contact Apple Support for refund requests.
6. Acceptable Use
You agree not to:
- Use the App for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Circumvent any security features of the App
- Use the App in any way that could damage or impair the service
- Redistribute or sell access to the App
7. Intellectual Property
The App and its original content, features, and functionality are owned by Shark and are protected by international copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute the App
- Use our trademarks without permission
- Create derivative works based on the App
8. Your Data
You retain ownership of all data you enter into Shark. We do not claim any rights to your personal health data. Please see our Privacy Policy for details on how we handle your information.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Accuracy of predictions or insights
- Uninterrupted or error-free operation
- Fitness for a particular purpose
- Non-infringement of third-party rights
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data
- Health-related decisions made based on the App
- Inaccurate predictions
- Device issues or data loss
11. Indemnification
You agree to indemnify and hold harmless Shark and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
12. Changes to Terms
We may update these Terms from time to time. When we do:
- We'll update the "Last updated" date
- For significant changes, we'll notify you in the App
- Continued use after changes means you accept the new Terms
13. Termination
You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend access to the App for violations of these Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
